Erste Reaktionen auf das Tauschbörsen-BGH-Urteil von Seiten der Abmahnmaschinerie – die “Next Generation”-Abmahnung?

Vor wenigen Tagen erging das mit Spannung erwartete BGH-Urteil zur Frage der Haftung des Internetanschlussinhabers bei Musiktauschbörsen-Abmahnungen. Wir haben bereits darüber berichtet. Sie finden die entsprechenden Beiträge hier:

Die Urteilsgründe der Entscheidung liegen zwar noch nicht vor, einige vorsichtige Tendenzen lassen sich aber gleichwohl aus der Pressemitteilung des Bundesgerichtshofs entnehmen.

So haftet der Betreiber eines privaten WLAN-Netzes nicht, wenn er seinen Prüfpflichten genügt hat. Die Prüfpflicht bezieht sich dabei auf die Einhaltung der im Zeitpunkt der Installation des Routers für den privaten Gebrauch marktüblichen Sicherungen. Nicht erforderlich ist hingegen eine fortlaufende Anpassung der Sicherung nach dem jeweils aktuellen Stand der Technik. Privatpersonen mit WLAN sind daher gut beraten, wenn Sie die Sicherung ihres WLANs nochmals auf den Prüfstand stellen und diese durch ein personalisiertes Passwort hinreichend abzusichern.

Noch in einem weiteren Punkt lässt die Pressemitteilung eine Tendenz erkennen, welche gegenwärtig sowohl im Lager der Betroffenenvertreter als auch im Lager der sog. “Abmahnkanzleien” für Furore sorgt. In einem Klammerzusatz weist die Pressestelle des BGH darauf hin, dass für die Abmahnkosten nach geltendem (im Streitfall aber noch nicht anwendbaren Recht) maximal Euro 100,00 anfallen können. Diese – sozusagen en passent – getätgte Aussage gibt Anlass zu unterschiedlichsten Spekulationen. Nach unseren Informationen war die Frage der Euro 100,00 – Deckelung des § 97a Abs. 2 UrhG zu keinem Zeitpunkt Gegenstand des Verfahrens, noch wurde die Deckelung in Schriftsätzen oder der mündlichen Verhandlung zur Sprache gebracht. Letztlich war die Euro 100,00 – Klausel für den vorliegenden Fall auch nicht relevant, bezog sich der Streitfall doch auf einen angeblichen Verstoß, der vor September 2008 und damit vor Geltung des § 97a Abs. 2 UrhG begangen wurde.

Ganz offensichtlich war der Hinweis dem BGH aber ein besonderes Anliegen. Worauf genau sich aber nun die Euro 100,00 – Deckelung beziehen soll, wird durch den kurzen Klammerzusatz in der Pressemitteilung freilich nicht beantwortet:

  • Bezieht sich die Euro 100,00 Deckelung nur auf sog. “Einlied-Abmahnungen”, also Abmahnungen in denen lediglich ein einzelner Musiktitel abgemahnt wird?
  • Bezieht sich die Euro 100,00 Deckelung nur auf Fallgestaltungen, die der weitgehend entsprechen, die dem vom BGH zu entscheidenden Fall zu Grunde lag?
  • Bezieht sich die Euro 100,00 Deckelung nur auf die Fallgestaltung des nicht hinreichend gesicherten WLANs?
  • …

Wir wissen es nicht. Niemand weiß es. Weder Betroffenenvertreter, noch die sog. “Abmahnkanzleien”. Es steht nicht einmal fest, ob die noch ausstehende Urteilsbegründung des BGH diesbezüglich tatsächlich geeignet sein wird, Licht ins Dunkel zu bringen.

Gleichwohl ist zu vermuten, dass selbst eine Deckelung der Abmahnkosten durch den BGH wohl nicht zu einem Ende der “Abmahnindustrie” führen wird. Auf Betroffenenseite wie auf Abmahner-Seite sind häufig hochspezialisierte Juristen am Werk, die vor allem eines sind: anpassungsfähig und ideenreich.

Schon zuvor zeichneten sich Tendenzen in der instanzgerichtlichen Rechtsprechung ab, wonach es für den Abgemahnten immer schwieriger wird, den Bereich der Täterschaft zu verlassen um “nur noch” als sog. Störer in Anspruch genommen zu werden. In einer Abmahnung wird regelmäßig neben den Kosten der Abmahnung (nur auf diese ist die Euro 100,00 Deckelung anwendbar) auch stets Schadenseratz veranschlagt wird. Sekundäre Darlegungslasten und Anscheinsbeweise machen es den Betroffenen häufig schwer, den Nachweis zu erbringen, dass sie selbst als Filsharer und Urheberrechtsverletzer ausscheiden – häufig ist der genaue Sachverhalt gar nicht mehr exakt zu rekonstruieren, liegt doch zwischen Zeitpunkt des angeblichen Verstoßes und dem Zeitpunkt der Abmahnung regelmäßig ein Zeitraum von mehreren Monaten. Und wer weiß schon, was er selbst oder Familienangehörige vor drei Monaten zu einem bestimmten Zeitpunkt gemacht haben?

Sollte tatsächlich die Euro 100,00 Klausel des § 97a Abs. 2 UrhG zur Anwendung kommen, in welcher Reichweite auch immer, bleibt immer noch die Frage, welche Anforderungen zu erbringen sind, um einer Schadenseratzpflicht zu entgehen. Schließlich hat nicht jeder das Glück, zum Zeitpunkt der vorgeworfenen Urheberrechtsverletzung nachweislich im Uraub gewesen zu sein.

Uns liegt eine Abmahnung der Kanzlei Rasch vor, in der die Kanzlei Rasch aus Hamburg erstmals im Auftrag Universal Music GmbH (wie im übrigen zahlreiche andere Rechteinhaber auch) Titel aus der bekannten “German Top 100 Single Chart List” abmahnt. Die Abmahnung unterscheidet sich jedoch in einem wesentlichen Punkt von anderen Abmahnungen, die in der Vergangenheit regelmäßig von anderen Rechteinhabern (bspw. Digiprotect) im Rahmen der” German Top 100 Single Chart List” ausgesprochen wurden. Es wird nicht ein Titel, sondern gleich mehrere, hochaktuelle Titel – insgesamt sieben – abgemahnt. Darunter auch einige Titel der Künstlerin Lena Meyer-Landrut, unserer Hoffnung auf den lang ersehnten Sieg für den Grandprix Eurovision Song Contest 2010.

Es erscheint in höchstem Maße fraglich, ob derartige Abmahnungen, die gleich mehrere Verletzungen hochaktueller Musikwerke zum Gegenstand haben, auch unter den § 97a Abs. 2 UrhG fallen können. Klarheit werden nur die Urteilsgründe des BGH liefern können. Zumindest besteht die Hoffnung. Sollte die Abmahnung der Kanzlei Rasch im Auftrag der Universal Music GmbH tatsächlich eine erste Reaktion auf die Veröffentlichung der Pressemitteilung des BGH sein, so zeigt sich eines mit Gewissheit: die Musikbranche ist anpassungsfähig und stellt sich in rasantem Tempo auf neue Begebenheite ein. Die uns vorliegende Abmahnung ist datiert auf den  17.05.2010 – gerade einmal fünf Tage nach Veröffentlichung der Pressemitteilung.

Selbstverständlich halten wir Sie über aktuelle Entwicklungen auf dem Laufenden.

    Sehr geehrte Kollegen, bei uns sind nun auch schon drei dieser Abmahnungen neuen Strickmusters eingeschlagen. Wir vermuten auch, dass die Zusammenfassung mehrerer Einzelsongs in einer Abmahnung eine Reaktion von Rasch RAe sein könnte, das gefährdete Geschäftsmodell zu retten. Gleichwohl halten wir den Versuch für untauglich, wenn der BGH die Bagatellregelung auch bei ganzen Alben für anwendbar halten sollte. Welchen Unterschied soll zwischen 7 Songs eines Chartcontainers und einem halbwegs aktuellen Album bestehen ? Die Felle sind jedenfalls jetzt schon gut ins Schwimmen geraten.
