Where did they obtain my address details?
Internet users leave traces. All internet connections have what is called an IP address. This is visible to third parties. Specifically developed software documents the IP address, the file offered for upload and the exact time of the copyright infringement.
Based on the time and the IP address, the internet connection and therefore its owner can now be established. However, only internet providers (e.g. Arcor, Telekom, etc.) know which IP address is allocated to a particular internet connection at a given time.
In order to obtain this information, the internet provider can be asked for a disclosure of information (request for information according to German civil law).
Alternatively, a charge can be brought against an “unknown party”. The prosecution can then establish who the owner of the internet connection is. Finally, all the copyright holder has to do is request access to the records in order to obtain the address details required for the cease-and-desist letter.
