Should I argue with what is stated in cease-and-desist letters?
A recurring question with clients is whether there is any point in arguing with what is stated in cease-and-desist letters. The clear answer is no. Challenging its contents will still leave the cease-and-desist letter in place and has no effect whatsoever. Arguments contradicting what is stated are comparable to ignoring the cease-and-desist letter altogether.
